Agreement
- This is an electronic
contract, which sets out the terms of your use of the Conquer Chiari On-Line
Meeting Place. By clicking on the “I Agree” button, you agree to be legally
bound by all the terms of this Agreement.
- The Conquer Chiari On-Line
Meeting Place is provided as a free service. As such, there is no guarantee
express or implied with regard to its use. Use of the Conquer Chiari
On-Line Meeting Place is at your own risk.
- You must be at least
eighteen (18) years of age to use the Conquer Chiari On-Line Meeting Place.
By clicking on the “I Agree” button, you represent and warrant that you are
at least eighteen (18) years of age and have the right, authority and
capacity to enter into this Agreement.
- The Conquer Chiari On-Line
Meeting Place is for the personal use of individuals interested in
exchanging information about Chiari and Syringomyelia only and it may not be
used in connection with any commercial enterprise or endeavor. Illegal or
unauthorized use of information obtained from or through the Conquer Chiari
On-Line Meeting Place, including use of names, addresses, telephone numbers,
or e-mail addresses for the purpose of sending unsolicited communications of
any sort whatsoever, whether in person, by telephone, mail service, or
electronically, is prohibited and may be the subject of appropriate legal
action.
- Participants in the
Conquer Chiari On-Line Meeting Place are solely responsible for the content
of communications with other participants. The C & S Patient Education
Foundation does not guarantee the accuracy, completeness, or usefulness of
any information, nor does it adopt, endorse or accept responsibility for the
accuracy or reliability of any opinion, advice, or statement made by any
participant in the Conquer Chiari On-Line Meeting Place. Under no
circumstances will the C & S Patient Education Foundation, or its officers,
directors, or employees, be responsible for any loss or damage resulting
from your reliance on information or other content transmitted or
communicated by participants in the Conquer Chiari On-Line Meeting Place.
- The C & S Patient
Education Foundation does not in any way screen participants in this On-Line
Meeting Place, nor does it inquire into their backgrounds or attempt to
verify their statements or information placed on the On-Line Meeting
Place. You are solely responsible for your interaction with other
participants in the Conquer Chiari On-Line Meeting Place. In no event
shall the C & S Patient Education Foundation be liable for any damages
whatsoever, whether direct, indirect, general, special, compensatory,
consequential, incidental, and/or punitive arising out of or relating to the
conduct of you or anyone else in connection with the use of the Conquer
Chiari On-Line Meeting Place, including without limitation, bodily injury,
emotional distress, economic loss, injury to reputation and/or any other
damages resulting from communications, on-line meetings or other
meetings/exchanges of information with other participants.
- You are solely responsible
for the information that you place on the Conquer Chiari On-Line Meeting
Place or communicate to other participants. You agree that you will not
communicate or transmit to other participants any defamatory, abusive,
obscene, profane, offensive, sexually oriented, threatening, harassing,
racially offensive, or illegal material or any material that infringes or
violates another party’s rights, including intellectual property rights, and
rights of privacy. You also agree that you will not knowingly provide
inaccurate, misleading or false information to the C & S Patient Education
Foundation or to any participant in the Conquer Chiari On-Line Meeting
Place.
- All disputes relating to
the terms of this Agreement, and the use of the Conquer Chiari On-Line
Meeting Place, either directly or indirectly, will be subject to binding
arbitration according to the rules of the American Arbitration Association
for commercial matters, such arbitration to be held in Pittsburgh,
Pennsylvania, utilizing the laws of the Commonwealth of Pennsylvania, and
all participants in the Conquer Chiari On-Line Meeting Place consent to
jurisdiction and venue in this locale.
- The C & S Patient
Education Foundation, its officers, directors, and employees are not
responsible for the conduct, whether on-line or off-line, of any participant
in the C & S On-Line Meeting Place. Notwithstanding, the C&S Patient
Education Foundation reserves the right to take from any participant the
privilege of using this Conquer Chiari On-Line Meeting Place, for any reason
and at any time. Further, if you have any reason to suspect any violations
of this Agreement or other misuse of the Conquer Chiari On-Line Meeting
Place, please report to director@conquerchiari.org.
